INTRODUCTION

Rock Beer Gear (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”).

This Privacy Policy explains how we collect, process, use, disclose, share, hold and safeguard your information that you may provide while visiting our website or when you make a purchase on our website.

We are committed to ensuring that your privacy is protected, and we take it seriously. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this Privacy Policy.

This Privacy Policy affects your legal rights and obligations so please read it carefully. If you do not agree with the terms of this Privacy Policy, please do not access the website. By using or accessing the website in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent with them.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the website, and you waive the right to receive specific notice of each such change or modification. You are encouraged to periodically review this Privacy Policy to stay informed of the updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Site after the date such revised Privacy Policy is posted.

If any provision of this Policy is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.

WHAT DOES THIS PRIVACY POLICY COVER

This Privacy Policy covers our treatment of personally identifiable information (Personal Information) that we gather when you are accessing or using our website, but not the practices of companies / third parties we don’t own or control, or people that we don’t manage.

WHAT KIND OF INFORMATION WE COLLECT

When you visit the Rock Beer Gear website, we, or third parties on our behalf, automatically collect and record certain information about your computer or (mobile) device and your activities, including information about your web browser, operating system, device ID, model, manufacturer, IP address, geolocation data, your preferences, and settings such as time zone and language, and statistical data about your browsing actions and patterns. Additionally, as you browse the website, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the website, and information about how you interact with the website. We refer to this automatically collected information as Device Information.

We collect Device Information using the following tracking tools and technologies on the website – cookies, log files, web beacons, tags, pixels. We use the information we collect on an anonymous basis to help customize the website and improve your experience, products, and services we provide, and for analytical and research purposes – we use these tracking tools and technologies for measuring aggregate web statistics, including number of monthly visitors, number of repeat visitors, most popular webpages, and other information.

Cookies are small data text files that are placed on your (mobile) device or computer and often include an anonymous unique identifier. A cookie is a small file that asks permission to be placed on your computer or device. Once you agree, the file is added (through your browser). Essentially, it is a piece of data stored on the user’s computer or device, containing information about the user. A cookie helps us analyze web page traffic or lets you know when you visit a particular site – they are used by websites to identify when users revisit those websites. Cookies allow us to recognize your browser or device and tell us how and when pages are visited, how often a particular feature of the website is used, by how many people, and what they are interested in. Therefore, we may use this data to customize content for you that we think you might like, based on your usage patterns, and we can use that knowledge to make the website interesting to as many users as possible. Essentially, cookies allow web applications to respond to you as an individual. The website can be tailored to your needs, likes, and dislikes by gathering and remembering information about your settings and preferences, so that you will not need to resubmit certain information. Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. Cookies identify your browser but will not let a website know your name and/or address. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. We only use this information for statistical analysis purposes and then the data is removed from the system.

Most web browsers are initially set to accept cookies by default. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies and therefore choose to accept or decline cookies. If you remove or reject cookies, be aware that such action could affect the availability and functionality of the website. In other words, this may prevent you from using the features and taking full advantage of our website and therefore affect your experience.

If you click on a link to a third-party website or service, a third party may also transmit cookies to you. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our website.

Log files track actions occurring on the website, and collect data including your IP address, browser type, internet service provider, referring/exit pages, and date/time stamps. We log standard technical information, such as your IP address and the kind of browser you use. We log this information for troubleshooting purposes and to improve the website. We do not use log files to track a particular individual’s use of the website.

Web beacons, tags, and pixels are electronic files used to record information about how you browse the website. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Because your web browser must request these advertisements and web beacons from the ad network’s servers, these companies can view, edit, or set their own cookies, just as if you had requested a web page from their site.

You may be able to opt-out of web beacon tracking conducted by third parties through our website by adjusting the Do Not Track (DNT) settings on your browser (please note that we don’t control whether or how these third parties comply with Do Not Track requests). In other words, you may not be able to decline web beacons, however, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis. It is important to note that most web browsers and some mobile operating systems include a DNT feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

We may also use third-party Website Analytics Services such as Google Analytics and others, and we may use embedded images in emails to track open rates for our mailings, so that we can tell which mailings appeal most to our customers. Website Analytics Services collect information anonymously and generate reports detailing information such as the number of visits to the website, where visitors generally came from, how long they stayed on the website, and which pages they visited. This helps us understand traffic patterns and know if there are problems with our website. Website Analytics Services place several persistent cookies on your computer’s hard drive. If you do not agree to this, you can disable persistent cookies in your browser. This will prevent Website Analytics Services from logging your visits. By accessing the website, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer Personal Information to these third-party vendors.

You should be aware that getting a new computer, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain opt-out cookies, plug-ins, or settings.

In addition to Device Information, when you make a purchase or attempt to make a purchase through the website, we collect certain information from you, including your name, billing address, shipping address, payment information, email address, and phone number. We refer to this information as Order Information. When we talk about Personal Information in this Privacy Policy, we are talking about both Device Information and Order Information.

In terms of Order Information, please note that we store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processors such as PayPal, Stripe, Apple Pay, Google Pay and others, and you are encouraged to review their privacy polices and contact them directly for responses to your questions.

We may also collect personal data that you give to us about other people, such as Order Information if you use their payment information, their address as shipping address etc. You agree that you have notified any other person whose personal data that you provide to us of this privacy notice and, where necessary, obtained their consent so that we can lawfully process their personal data in accordance with this policy.

All personal data that you provide to us must be true, complete, and accurate. If you provide us with inaccurate or false data, and we suspect or identify fraud, we will record this.

When you contact us by email or post, we may keep a record of the correspondence and we may also record any telephone call we have with you.

You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of our website and/or completing a purchase.

HOW WE USE YOUR INFORMATION

We are committed to protection of your privacy online. When you place an order through the website, we will maintain your Order Information for our internal record keeping. We use the Order Information that we collect to manage and fulfill any orders placed through the website (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use the Order Information to communicate with you, resolve disputes and troubleshoot problems, and to screen our orders for potential risk or fraud and other criminal activities.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our website (for example, by generating analytics about how our customers browse and interact with the website, and to assess the success of our marketing and advertising campaigns).

We use the information to operate this website in general, send news and information to you about Rock Beer Gear, solicit your participation in our events and activities, and obtain and confirm RSVPs to events and activities. We use your e-mail address to send you marketing communications, which may include newsletters, blog posts, surveys, promotional offers and information about new products and services, and may use your telephone number to call you for these purposes. We also use this information to understand your needs and provide you with a better service – we may use the information for improving our products and services, sending special offers or other information we think you may find interesting, contacting you for market research purposes, and customizing the website according to your interests. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services.

SHARING / DISCLOSURE OF YOUR PERSONAL INFORMATION

We will not sell, distribute, or lease your Personal Information in personally identifiable form to anyone. We may use your Personal Information to send you promotional information about third parties we think you may find interesting.

We may share information we have collected about you in certain situations. Your information may be disclosed as described below.

We employ other companies and people such as service providers, sub-contractors, and agents that we may appoint to perform tasks on our behalf and need to share your information with them to provide products or services to you for us or on our behalf and in accordance with our instructions, including payment providers, email communication providers, IT service providers, accountants, auditors, and lawyers. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us.

Under certain circumstances we may have to disclose your Personal Information as permitted or required under any applicable laws, rules, or regulations, for example, as part of anti-money laundering processes. Similarly, we may share your Personal Information to respond to a subpoena, search warrant or other lawful requests for information we receive, to investigate or remedy potential violations of our policies, or to otherwise protect our rights, property, and safety, as well as the rights, property, and safety of others from fraudulent, abusive, or unlawful conduct, or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay. This includes exchanging information with other entities for fraud protection and credit risk reduction.

We may also share your Personal Information in connection with, or during negotiations of any merger, sale of assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company. If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline to honor commitments we made in this Privacy Policy.

When you post comments, contributions and/or reviews and other content to the website, your posts may be viewed by all users and may be publicly distributed outside the website in perpetuity.

We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly.

ADVERTISING

As mentioned above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you.

We may use third-party software to serve ads on the website, implement email marketing campaigns, and manage other interactive marketing initiatives. This third-party software may use cookies or similar tracking technology to help manage and optimize your online experience with us.
